1. Introduction and Acceptance of Terms

Welcome to Gymbrada ("Company", "we", "our", "us"). These Terms of Service ("Terms") govern your access to and use of the website gymbrada.com, associated applications, and all related services (collectively, the "Services"). By accessing or using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, please refrain from using our Services.

2. Description of Services

Gymbrada provides a digital fitness platform that includes:

  • Subscription Bundles: Three tiers — New Me, Grinding Hard, and Pro — combining supplements, personalized training programs, and nutrition plans.
  • Supplements: Products shipped directly to you via dropshipping fulfillment.
  • Training Programs: AI-generated personalized workout plans based on a fitness questionnaire.
  • Nutrition Plans: Personalized dietary recommendations.

3. Account Registration and Responsibilities

To access certain Services, you may be required to create an account. When creating an account, you agree to:

  • Provide accurate, current, and complete information.
  • Maintain the confidentiality of your login credentials.
  • Notify us immediately of any unauthorized use of your account.
  • Be at least 18 years old, or have parental/guardian consent.

You are solely responsible for all activity that occurs under your account.

4. Subscription and Billing

Billing Cycle: Subscriptions are billed on a monthly basis. The first charge occurs at sign-up, with subsequent charges on the same date each month.

Auto-Renewal: Your subscription will automatically renew each month until cancelled. You will receive notification prior to each renewal.

Cancellation: You may cancel your subscription at any time through your account settings or by contacting us. Cancellation takes effect at the end of the current billing period.

Payment Processing: Payments are processed through PayPorto, a secure payment provider. We do not store your credit card details on our servers.

5. Refund Policy

Digital Services: Due to the nature of digital services (training and nutrition plans), once generated and delivered, they are non-refundable. You may cancel your subscription to prevent future charges.

Physical Products: Unopened supplements may be returned within 14 days of delivery in accordance with Israeli Consumer Protection Law. Return shipping costs are the responsibility of the buyer.

6. Product Delivery

Supplements are shipped via dropshipping fulfillment from international suppliers. Delivery times vary by geographic location and may range from 7 to 21 business days.

We are not responsible for delays caused by customs authorities, local postal services, or force majeure. A tracking number will be provided upon shipment.

7. Intellectual Property

All content, designs, logos, text, graphics, training programs, nutrition plans, software code, and any other material available through the Services are the exclusive property of Gymbrada or its licensors and are protected by Israeli and international intellectual property laws. No content may be copied, distributed, reproduced, or used to create derivative works without express written permission.

8. User Content and Conduct

When using our Services, you agree not to:

  • Provide false or misleading information in the fitness questionnaire.
  • Share your personalized training or nutrition plans with others.
  • Use the Services for any unlawful purpose.
  • Attempt to access systems or data without authorization.
  • Interfere with the operation of the Services or their infrastructure.

We reserve the right to suspend or terminate accounts that violate these Terms.

9. Privacy

Your use of the Services is also subject to our Privacy Policy, which details how we collect, use, and protect your personal information. The Privacy Policy is incorporated by reference into these Terms.

10. Health Disclaimer

Our Services do not constitute medical advice. Training and nutrition plans are AI-generated and intended for general informational purposes only. You are strongly advised to consult with a physician or qualified health professional before beginning any new exercise or dietary program, especially if you have pre-existing medical conditions.

11. Limitation of Liability

To the maximum extent permitted by law, Gymbrada, its directors, employees, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from:

  • Your use of or inability to use the Services.
  • Any injury or health damage resulting from following training or nutrition plans.
  • Any product purchased through the platform.
  • Unauthorized access to or alteration of your data.

Our total liability shall not exceed the amount you paid to Gymbrada in the three months preceding the claim.

12. Governing Law

These Terms shall be construed and governed in accordance with the laws of the State of Israel, without regard to conflict of law principles. Any dispute arising from or relating to these Terms shall be subject to the exclusive jurisdiction of the competent courts in Israel.

13. Changes to Terms

We reserve the right to update or modify these Terms at any time. Material changes will be posted on the website and/or communicated to you via email. Continued use of the Services after changes are posted constitutes acceptance of the updated Terms.
